GENERAL TERMS AND CONDITIONS OF SALE
Scope of Application

S.A.R.L. Château Maucamps (hereinafter referred to as the “Seller” or “Château Maucamps”), whose complete contact details and identification are specified in the “Legal Notice” section below, operates an e-commerce service available at the following website: www.chateaumaucamps.com (hereinafter the “Site”), intended for consumer clients (hereinafter the “Client(s)”), i.e., any natural person acting for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal, or agricultural activity.

Acceptance of the General Terms and Conditions of Sale

Unless otherwise specifically agreed in writing between the parties, all orders placed on the Site are automatically subject to these General Terms and Conditions of Sale, which prevail over any other document, such as brochures, advertisements, catalogues, or marketing emails issued by the Seller, which are provided for informational purposes only.

Using the Site and/or placing an order implies prior consultation and acceptance of these General Terms and Conditions of Sale in their entirety.

Château Maucamps reserves the right to adapt or modify these terms at any time. In case of modification, the applicable version will be the one in force on the date of the order.

The fact that Château Maucamps does not enforce any clause of these terms or any right shall not be interpreted as a waiver of its right to do so subsequently.

Offers / Pricing / Orders

All our offers for deliverable wines are valid while stocks last, excluding promotions, special offers, and gifts. For en primeur wines, please refer to the conditions specified in the offer, subject to stock availability.

Prices are expressed in Euros, all taxes included.

Given the rare nature of certain products, we reserve the right to apply restrictions on available quantities. In the event of stock depletion, Château Maucamps will make every effort to indicate this and/or make it impossible to purchase the affected wine. Despite all precautions taken, it is possible, in exceptional cases, that a wine ordered may no longer be available. In such cases, Château Maucamps will immediately inform the Client, who will then be reimbursed in full for the amount paid using the same payment method.

Given the rare nature of certain products, we reserve the right to apply restrictions on available quantities, or even to refuse or cancel an order that is clearly abnormal. Our offers are exclusively reserved for consumer clients, and under no circumstances for professional resellers.

After reviewing the products offered on the Site and, if necessary, contacting Château Maucamps’ customer service, the Client is invited to add one or more products to their virtual cart. By consulting their virtual cart, the Client accesses a summary of their order (product references, quantities, unit price, total price including VAT, etc.) so they can modify it if needed. The Client is then invited to select a delivery method from those offered (timeframe, method, cost, etc.), enter their delivery and billing addresses, use any promotional codes, and proceed with payment after accepting these general terms and conditions of sale. A confirmation message summarizing the essential features of the order and containing (or allowing the Client to download or print) the general terms and conditions of sale is then sent to the Client (if not, the Client is invited to contact Château Maucamps using the contact details provided in the “Legal Notice” section). Orders are only final upon receipt of full payment for the goods.

Prices are expressed in Euros, all taxes included. In the event that an abnormally low price is displayed due to a technical or human error, Château Maucamps reserves the right to ask the Client to pay the outstanding balance or to cancel the order and refund all amounts already paid. Château Maucamps may organize various promotional campaigns, notably in the form of crossed-out prices as part of, for example, private sales. These offers are based on reference prices established in accordance with applicable regulations.

Payment Terms

Payment for goods must be made in full at the time of ordering, by credit card (Debit Card, Visa, Eurocard Mastercard, American Express), or via Apple Pay or Google Pay through the Stripe platform. No payment deferrals may be granted without our prior express consent. Online payments are fully secured through SSL protocols and anti-fraud protection measures implemented by our partner Stripe.

Deliverable Wines

An invoice expressed in Euros including all taxes will be issued by Château Maucamps and sent to the Client at the billing address provided. For any order over 380 Euros including VAT delivered in a single shipment to an address in mainland France, delivery is free of charge. For any order under 380 Euros including VAT, a contribution to shipping costs will be requested (See the “Delivery” section).

Foreign Sales / International Deliveries

The sale and delivery of alcoholic beverages abroad are subject to the laws and regulations in force in the destination country. It is the Client’s sole responsibility to ensure that purchasing wine from Château Maucamps and having it delivered is permitted in their country of residence or in the destination country, and to check for any applicable customs duties, local taxes, or other import fees.

Château Maucamps accepts no responsibility in the event of non-compliance with local legislation by the Client.
Any additional costs related to importation (customs duties, local taxes, levies, etc.) will be entirely borne by the Client and cannot be covered by Château Maucamps.

In the event that the goods are refused by the authorities of the destination country or delivery is impossible due to legal reasons, no refund of the order price or shipping costs will be made.

Delivery

Deliveries are carried out according to the terms (address, price, etc.) agreed upon at the time of ordering. Goods are insured by us during transport within mainland France and travel at our risk. Deliveries are made within a maximum of 30 working days from receipt of full payment of the final invoice, with the understanding that any delivery time shorter than 30 working days indicated on the Site is purely indicative and shall not be binding on Château Maucamps. If the 30-day delivery period is not met, except in cases of force majeure, the Client may terminate the contract by registered letter with acknowledgment of receipt or by written notice on another durable medium, if, after having requested, under the same conditions, that Château Maucamps make the delivery within an additional reasonable period, Château Maucamps fails to do so. The Client may immediately cancel the order if the delivery period constituted an essential condition of the contract. This essential condition must result from the circumstances surrounding the conclusion of the contract or from an express request by the Client prior to the contract’s conclusion. To do so, the Client must send the cancellation by registered letter with acknowledgment of receipt to the following address: Château Maucamps, 19 avenue de la Libération, 33460 Macau-en-Médoc. The Client will be refunded the amount paid, excluding any other compensation or damages, no later than 14 days following the date on which the contract was terminated. In the event of incorrect information provided by the Client, Château Maucamps cannot be held responsible for the inability to deliver the goods to the correct place and on time.

France Deliveries via Colissimo 48–96 hours

You can choose express delivery within 48–96 hours, from Monday to Friday (no deliveries on Saturdays, Sundays, or public holidays), for any order placed and confirmed the previous day before 11:00 a.m. in mainland France. Whenever possible, 12-bottle cartons will be prioritized.

Home delivery:

1 carton of 6 bottles: €26 incl. VAT
1 carton of 12 bottles: €35 incl. VAT
18 bottles: €60 incl. VAT
24 bottles: €68 incl. VAT
Maximum of 24 bottles per shipment.

Pickup point delivery:

1 carton of 6 bottles: €23 incl. VAT
1 carton of 12 bottles: €32 incl. VAT
18 bottles: €52 incl. VAT
24 bottles: €61 incl. VAT
Maximum of 24 bottles per shipment.

Upon receipt of the goods, it is your responsibility to check their condition and to make any necessary remarks in the event of breakage, damage, or missing items, by clearly and legibly stating your reservations on the delivery note, and within three days (excluding public holidays) following the date of receipt, by registered letter with acknowledgment of receipt to the carrier, with a copy to the Seller, in order to preserve your rights.

Retard de paiement

Any amount not paid by the due date will automatically and by law, without prior formal notice and for each day of delay, incur a penalty corresponding to the unpaid amount multiplied by the applicable legal interest rate. In the event of recovery through legal action, this will give rise to a proportional indemnity corresponding to the costs incurred for said recovery, which Château Maucamps estimates at 15% of the order amount.

Withdrawal Right

You have the right to withdraw from this contract without giving any reason within fourteen (14) days. The withdrawal period expires 14 days after the day you, or a third party other than the carrier and designated by you, takes physical possession of the goods.

The Client may also, upon express written request, exercise the right of withdrawal from the date of conclusion of the contract.

If the order concerns multiple items delivered separately, the period expires 14 days after you or your designated third party takes possession of the last item.

For regular deliveries over a defined period, the period expires 14 days after the first item is received.

To comply with the deadline, it is sufficient for your communication regarding the exercise of the right of withdrawal to be sent before the withdrawal period has expired.

Effects of Withdrawal: In case of withdrawal, we will reimburse all payments received, including delivery costs (except additional charges for choosing a more expensive delivery method than the standard option offered) without undue delay and no later than 14 days from receipt of your withdrawal request.

Reimbursement will be made using the same payment method used in the original transaction, unless otherwise agreed. No fees will be charged for the reimbursement.

We may defer the reimbursement until we have received the goods back or until you provide proof of return, whichever is earliest.

You must return the goods to the address shown on your invoice header without undue delay, and in any event, no later than 14 days from the date of notification of withdrawal.

You will be responsible for the direct cost of returning the goods (approximately €17 excl. VAT plus an average of €2.37 excl. VAT per bottle within mainland France).

The Client is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

Product Exchange

In the event that ordered products are out of stock, Château Maucamps may offer the Client, with their consent, a replacement with another vintage or an equivalent wine.

Retention of Title Clause

By express agreement, all goods remain the property of Château Maucamps wherever they are located until payment in full of the related invoice. However, the transfer of risk occurs upon delivery.

Legal Guarantees

The consumer has a two-year period from the date of delivery to benefit from the legal guarantee of conformity for any defect existing at the time of delivery. Within this period, the consumer only needs to prove the existence of the defect, not the date it appeared (12 months for second-hand goods).

The legal guarantee entitles the consumer to repair or replacement of the product within 30 days, free of charge and without major inconvenience.

If the product is repaired under warranty, the original guarantee is extended by six months. If the seller imposes a replacement instead of repair, the warranty restarts for two years from the replacement date.

The consumer is entitled to a price reduction or contract cancellation with a full refund and return of the product if:

  1. The professional refuses to repair or replace the item
  2. Repair or replacement takes longer than 30 days
  3. Repair or replacement causes significant inconvenience
  4. Non-conformity persists despite an attempted resolution

The consumer may also seek immediate resolution or price reduction if the defect is serious. There is no right to cancel the sale if the defect is minor.

Any immobilization of the product during repair suspends the warranty period.

These rights result from Articles L.217-1 to L.217-32 of the French Consumer Code.

Sellers obstructing warranty enforcement in bad faith may face a civil fine of up to €300,000 or 10% of annual turnover (Article L.241-5).

The Client also benefits from the legal warranty against hidden defects, valid for two years from discovery (Articles 1641–1649 Civil Code), allowing a full refund or price reduction.

Termination of the Contract

In case of non-payment or failure to collect goods within one month after a formal notice, the sale may be terminated by Château Maucamps. Any deposits will be refunded after deducting immobilization, administrative costs, and late penalties. The Seller may also request the return of the products.

Liability

Unless otherwise provided by mandatory legal provisions, Château Maucamps cannot be held liable for indirect damages caused by its actions or by the products sold on the Site, or for any kind of damages resulting from the unavailability of the Site. Château Maucamps shall also be fully or partially released from liability if it can prove that the alleged damage was caused by the Client, by a third party, or by a case of force majeure as defined in Article 1218 of the French Civil Code. Furthermore, the parties agree that the following events shall automatically be considered as cases of force majeure insofar as they are reasonably beyond the control of Château Maucamps, even if they do not meet all the conditions established by case law: strikes (announced or not) affecting the fulfilment of contractual obligations by Château Maucamps and/or its own suppliers, contractual failure by Château Maucamps resulting from its suppliers (e.g. delivery delays) or its carriers (e.g. delay, loss of goods), severe weather conditions (frost, storms, etc.), and any event beyond the control of Château Maucamps that renders performance impossible or calls into question the financial balance existing at the time the order was placed.

Dispute Resolution

In the event of difficulties in applying these general terms and conditions of sale, we encourage you to seek an amicable solution by first contacting our Customer Service using the contact details provided in the “Legal Notice” section below. In accordance with Articles L 611-1 and R 612-1 et seq. of the French Consumer Code regarding the amicable resolution of disputes, if you have submitted a written complaint to the professional and have not received a satisfactory response within two months, you may refer your complaint free of charge to the consumer mediator. The mediator must be contacted within a maximum period of one year from the date of the initial complaint. Applicable Law and Jurisdiction

These general terms and conditions of sale are governed by French law. If any clause of these general terms and conditions of sale is found to be null and void, this shall in no way affect the validity or enforceability of the remaining provisions. In the event of a dispute arising from or in connection with the placement or execution of an order, the Court of Bordeaux shall have jurisdiction in accordance with applicable common law rules.

Protection of Minors

In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcoholic beverages to minors is prohibited. The Client declares to be at least 18 years old at the time of the order.

Health Warning

Alcohol abuse is dangerous for your health. Drink responsibly.

Intellectual Property

In accordance with the provisions of Law No. 98-536 of July 1, 1998, transposing Directive 96/9/EC of March 11, 1996 on the legal protection of databases, Château Maucamps is the producer and owner of all or part of the databases comprising this Site. Furthermore, all content appearing on this Site (texts, images, photos, graphics, logos, icons) is protected by copyright. Any use or reproduction, even partial, of the Site or its content is strictly prohibited without the express permission of the author.

Personal Data Protection

As part of distance selling, Château Maucamps collects personal data from the Client. This information is necessary for managing the order and the business relationship. It is processed in accordance with the applicable regulations on personal data protection (GDPR).
